That lets it force them to pay too much for the apps, they argued.Apple had tried to stop the case, arguing that it could prove a problem for online sales.Apple shares were down about 5% after the justices, in a 5-4 ruling, upheld a lower court's decision to allow the proposed class action lawsuit to proceed. The plaintiffs said the Cupertino, California-based technology company required apps be sold through its App Store and extracted an excessive 30 percent commission on purchases.Conservative Justice Brett Kavanaugh, an appointee of President Donald Trump, joined the court's four liberal justices to rule against Apple and wrote the decision.Apple shares were trading down $10 at 187.13 by late morning.The company, backed by the Trump administration, argued that it was only acting as an agent for app developers, who set their own prices and pay Apple's commission. Apple had argued that a Supreme Court ruling allowing the case to proceed could pose a threat to e-commerce, a rapidly expanding segment of the U.S. economy worth hundreds of billions of dollars in annual sales.The dispute hinged in part on how the justices would apply a decision the court made in 1977 to the claims against Apple. In that case, the court limited damages for anti-competitive conduct to those directly overcharged rather than indirect victims who paid an overcharge passed on by others.Explaining the ruling from the bench, Kavanaugh said the 1977 precedent was "not a get-out-of-court-free card for monopolistic retailers," an apparent allusion to the popular board game Monopoly.Noting that they pay Apple - not an app developer - whenever buying an app from the App Store, the iPhone users who brought the case said they were direct victims of the overcharges. Apple said the consumers were indirect purchasers, at best, because any overcharge would be passed on to them by developers.Developers earned more than $26 billion in 2017, a 30 percent increase over 2016, according to Apple."Leaving consumers at the mercy of monopolistic retailers simply because upstream suppliers could also sue the retailers would directly contradict the longstanding goal of effective private enforcement in antitrust cases," Kavanaugh said.Dissenting from the decision, conservative Justice Neil Gorsuch, said that the decision is "not how antitrust law is supposed to work" because it gives a green light to the exact type of case that the court has previously prohibited. Gorsuch also was appointed by Trump.A spokeswoman for Apple could not immediately be reached.The plaintiffs, including lead plaintiff Robert Pepper of Chicago, filed the suit in a California federal court in 2011, claiming Apple's monopoly leads to inflated prices compared to if apps were available from other sources. They were supported by 30 state attorneys general, including from Texas, California and New York.Apple, which was also backed by the U.S. Chamber of Commerce business group, had sought to dismiss the case, arguing that the plaintiffs lacked the required legal standing to bring the lawsuit.After a federal judge in Oakland, California threw out the suit, the San Francisco-based 9th U.S. Circuit Court of Appeals revived it in 2017, finding that Apple was a distributor that sold iPhone apps directly to consumers.Additional reporting by Reuters

The handset was supposed to launch last month but in addition to being a terribly ugly handset, it also ended up being a piece of junk. Hopefully by the time Samsung actually releases the $2,000 phone, it'll only be ugly.In addition to possibly Galaxy Fold news, the most powerful Android smartphone of the year so far will debut on Tuesday. The OnePlus 7 Pro is rumored to be launching alongside two other new OnePlus models, and it's expected to feature an exciting new all-screen design that'll be the first of its kind here in the United States.Several other nifty new Android phones are set to hit store shelves in the coming months, including not one but two new Galaxy Note 10 handsets that should launch in early August. Despite all of these imminent releases, however, most of the attention of the rumor mill has already turned to Apple's upcoming new smartphones, the iPhone 11, iPhone 11 Max, and iPhone 11R (or whatever Apple ends up calling its new 2019 iPhone models). We've already seen several leaks describing the trio's new designs and features, so we have a pretty good idea of what to expect come September. If you're still unconvinced despite everything you've seen so far, two sources that have been reliable in the past both just leaked Apple's iPhone 11 design and firmed up everything we've seen and heard.We won't dive back into all of the leaks we've seen so far, but here's a quick refresher:Apple's new iPhone 11 and iPhone 11 Max are expected to look almost exactly like the concept phone shown in the render above and at the top of this post. They'll feature designs that are identical to the current iPhone XS series phones on the front, and the back will be the same apart from the new triple-lens camera array expected on both new iPhones. Apart from being huge and square, the new camera setup is also expected to be color-matched to the back of the phone instead of black, as has always been the case on iPhones in the past. iPhone 11 R design leaks have told a similar story, but the new square camera array will feature two lenses instead of three.As far a features go, there isn't too much to get excited about. We can expect more power and speed, of course, as well as a dramatically improved camera experience. Apart from that, we haven't heard too much of interest. Multiple sources have claimed that the new iPhone models will feature reverse wireless charging like Samsung's Galaxy S10 phones, which is pretty nifty. It's not something that's terribly useful in the real world, however.With all that in mind, we have two recent leaks to tell you about on Monday morning that should help allay any doubt that the leaks we've seen so far are accurate. First, Bloomberg reporter Mark Gurman posted a photo of "alleged next iPhone case moldings" on Twitter early Monday morning that shows the designs of all three new 2019 iPhone models.https://twitter.com/markgurman/status/1127798143347675136Here's a closer look:While the source of these case moldings wasn't named, they're believed to have been created using accurate next-generation iPhone schematics that were stolen from the Foxconn factory where Apple's new iPhone models will be assembled. The iPhone 11 design is pictured on the far left and the iPhone 11 Max design can be seen on the right, while the iPhone 11R design and its dual-lens camera setup is shown in the middle.Also of note, a person who used to leak tidbits regarding unreleased iPhone models briefly reemerged last week to post the following iPhone 11 and iPhone 11 Max case diagrams:Again, this leak reinforces the same design leaks we've seen several times already over the past few months. But it's still worth noting because the renders come from a source that has in the past shared accurate information regarding unreleased iPhone models.

Ukrainians Slam Rudy Giuliani's 'Shameful Play' to Meddle in Their PoliticsDrew AngererMOSCOW—Democracy-minded Ukrainians, of whom there are many, learned with grim bemusement this week that Donald Trump's eccentric lawyer, Rudy Giuliani, was on his way to Kiev. When they heard he canceled the trip as suddenly as he had announced it there was a collective sigh of relief.  But what the hell was he thinking? Giuliani's expressed intent was to politicize an investigation in a country where, for years, the Americans have encouraged Ukrainians to travel a difficult road toward the rule of law. Time and again U.S. officials have pleaded with Ukrainians to cleanse their justice system of politically-tainted investigations. It was as if a doctor had suddenly recommended taking up smoking. "Sounds like a shameful play—the arguments and motivations that U.S. Republicans are making seem all  distorted," Natalia Gumenyuk, head of Ukraine's independent Hromadske television, told The Daily Beast. Giuliani and other Trump allies have been openly cooperating with Ukrainian law enforcement to pursue two politically important cases in Ukraine. Their first concern is to discredit information about the alleged corruption of Paul Manafort, the former chairman of Trump's 2016 presidential campaign, by demonstrating its release by the Ukrainians was illegal. Manafort is serving his 47-month prison term in Scranton, Pa., for failure to pay U.S. taxes and fraud, and the Ukrainian investigation of Manafort helped touch off the wider Russia investigation, the origins of which Giuliani says he is trying to ferret out. The former mayor of New York, who now acts as a kind of media magnet and enforcer for Trump, also wants to show that former Vice President Joe Biden, a possible opponent in 2020, had a conflict of interest in Ukraine. Biden has faced allegations that he pressured prosecutors in Kiev to close a case against a company, Borisma, where his son, Hunter, served on the board. Biden has denied the charges.Giuliani had said he hoped to meet with the country's president elect, Volodymyr Zelenskiy, to ask him to continue these two investigations: into the origins of the Manafort case and Hunter Biden's business dealings. Gumenyuk, whose television channel has for years been carrying interviews with U.S. diplomats pressing for independent courts and prosecutors in Ukraine, said this effort was met in Kiev with an avalanche of criticism. "Everybody here saw evidence, and knows the truth about how Manafort was stealing millions from Ukraine," she said. Days before Zelenskiy's inauguration, Ukraine is more interested in whether the new president will dissolve the parliament and call new parliamentary elections. Trump's desire to win a U.S. election was not at the top of the agenda. Would Zelenskiy help Giuliani to discredit Biden? "This is laughable to expect President Elect Volodymyr Zelenskiy to commit political suicide now, and play a dangerous political game," television journalist Yevgeniy Kisilyev told The Daily Beast. "Trump fired the American ambassador to Ukraine for taking the side of our democratic optimists," he said. Career foreign service officer Masha Yovanovitch had been asked to stay on by Secretary of State Mike Pompeo but fell prey to a convoluted conspiracy theory promoted on Fox News."I don't expect Zelenskiy is going to make deals," said Kisilyev.During these final days before Zelenskiy's May 19 inauguration, every official, including Prosecutor General Yuriy Lutsenko, who has been cooperating with Giuliani, is seen as part of the old departing team. It's not clear who, if anybody, among the senior officials will remain in power in Kiev. Earlier this year, Giuliani met with Lutsenko to discuss the Biden case. Lutsenko opened a criminal investigation into Burisma that cited Biden's own words. Back in 2017 the former vice president talked about having pressed for the firing of Victor Shokin, a former prosecutor. In an interview with The Hill, prosecutor Lutsenko suggested that Biden did that to protect the company where his son worked. But that investigation had in any case been shelved, and there were certainly other reasons to seek the firing of a reputedly corrupt prosecutor. "Shokin has always been seen as widely corrupt," said Gumenyuk, noting that in one recent interview "he gave fake information about our tiny anti-corruption agency stealing money." It was unclear whether President Trump directed Giuliani to go to Ukraine, or if that was the lawyer's personal initiative. But dealing with prosecutor Lutsenko seemed a dubious move, Serhei Leschenko, a member of parliament, told The Daily Beast on Friday. The reason why Lutsenko was trying to help Giuliani was simple, he said: "The prosecutor wants to keep his job, he has no place to go," with the change of president. "He is using Americans to try to cling to his post." Ukraine, plagued by political scandal, needs a politicized investigation like a hole in the head. Strangely, even Manafort's longtime partner in Ukraine, Konstantin Kilimnik, whom U.S. authorities have said has links to Russian intelligence, re-emerged to comment on Giuliani's planned trip. He didn't think it would be a success: "It is unlikely that anybody in the current chaos would meet with Giuliani," Kilimnik told The Daily Beast. "This is a pure fantasy." On Friday, Sen. Chris Murphy (D-CT) called for an investigation of Giuliani's proposed trip to Ukraine. Later in the day, President Trump's lawyer called off his trip to Ukraine, claiming "enemies of the president, in some cases enemies of United States and in one case an already convicted person who has been found to be involved in assisting the Democrats with the 2016 election" were behind the alleged trickery.In the interview for Fox News Mr. Giuliani said he was talking about Ukraine MP Serhiy Leshchenko, whom Giuliani said had "supplied a black book [related to Manafort] that was found to be fraudulent."
